This privacy policy (the “Policy”) is intended to inform you of the types of information Moylan’s Insurance Underwriters, Inc (“we” or “us”) collects, as well as our policies and practices regarding the collection, use, and disclosure of that information through the web pages at https://moylansinsurance.com (the “Site”).

Please read this Policy carefully, because by using the Site, you are acknowledging that you understand and agree to the terms of this Policy, and consent to the manner in which we may collect, use and disclose the foregoing information. If you do not agree to the terms of this Policy, please do not use the Site.

We reserve the right to change the provisions of this Policy at any time. We will alert you that changes have been made by indicating on the Policy the date it was updated. We encourage you to review this Policy from time to time to make sure that you understand how any Personal Information you provide will be used. Your continued use of the Site following the posting of changes to these terms will mean you accept those changes.

Terms and Conditions

1. ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using the Moylan’s Insurance Underwriters mobile application (“the App”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must immediately uninstall the App and discontinue all use.

2. ELIGIBILITY AND ACCESS

The App is intended exclusively for current, active policyholders of Moylan’s Insurance Underwriters (“Moylan’s Insurance,” “we,” “us,” or “our”). Access to this App requires a valid Insured ID issued by Moylan’s Insurance.

If you are not a current policyholder of Moylan’s Insurance Underwriters, you are not authorized to use this App and must exit immediately.

Unauthorized access, attempted registration by non-policyholders, or misuse of another person’s Insured ID is strictly prohibited and may result in account suspension, termination, and/or legal action.

3. ACCOUNT REGISTRATION

To use the App, you must register an account using your Insured ID, email address, first name, last name, and a password you create. By registering, you confirm that:

– You are the authorized policyholder associated with the Insured ID provided.
– All information submitted during registration is truthful, accurate, and complete.
– You are solely responsible for maintaining the confidentiality of your login credentials.
– You are solely responsible for all activity that occurs under your account.
– You will immediately notify Moylan’s Insurance of any unauthorized use of your account.

Moylan’s Insurance reserves the right to refuse registration, suspend, or terminate any account at its sole discretion.

4. PAYMENT PROCESSING

4.1 Payment Gateway

All payments made through the App are processed securely by Authorize.net, a leading payment gateway trusted by thousands of businesses worldwide. All transactions are encrypted using industry-standard SSL/TLS technology and are subject to Authorize.net’s own terms of service and privacy policy.

4.2 Processing & Convenience Fees

A credit/debit card processing and convenience fee of 2.9% is applied to all transactions made through the App. This fee is clearly disclosed to you before you confirm any payment. By proceeding with a payment, you acknowledge and accept this fee.

4.3 Payment Application

Payments submitted through the App are transmitted to the Moylan’s Insurance policy management system (“Apollo System”) for processing. Updated balances may not be reflected immediately and will typically appear on your next billing cycle statement. A confirmation email will be sent to your registered email address upon successful payment.

4.4 Refunds

Payment refunds, if applicable, are subject to Moylan’s Insurance’s refund policy. Refund requests must be submitted directly to the Moylan’s Insurance office. The App does not process refunds.

5. AUTO-PAY

5.1 Enrollment

Auto-Pay allows you to enroll a debit or credit card for automatic recurring payments. When enrolled, your card will be automatically charged the full amount due on each billing cycle, plus the applicable 2.9% processing and convenience fee. You may cancel Auto-Pay at any time from within the App.

5.2 Charge Schedule

The Auto-Pay system checks for outstanding balances daily. If an amount is due on your account, your enrolled card will be charged automatically. If no balance is due, no charge will be processed.

5.3 Failed Charges

If an Auto-Pay charge is declined, you will be notified via email. Your Auto-Pay enrollment will remain active and will attempt to charge your card on the next billing cycle. It is your responsibility to ensure your card on file is valid and has sufficient funds.

5.4 Cancellation

You may cancel Auto-Pay at any time through the App. Upon cancellation, your card information will be removed from our payment processor’s system, and no further automatic charges will be made. You will be responsible for making manual payments for any outstanding balances.

6. CARD SECURITY AND TOKENIZATION

Moylan’s Insurance does not store your full credit or debit card number — not in the App, not on our servers, and not in any database.

When you make a payment or enroll in Auto-Pay, your card details are transmitted directly to Authorize.net. For Auto-Pay enrollments, Authorize.net’s Customer Information Manager (CIM) replaces your card number with a secure, encrypted token. This token allows us to process future charges without ever accessing or storing your actual card information.

Even in the unlikely event of a data breach, your full card number cannot be retrieved from the token. This approach meets PCI-DSS (Payment Card Industry Data Security Standard) compliance requirements, the highest level of security in the payment industry.

Only the last four digits of your card number and the card type (Visa, Mastercard, etc.) are stored for display purposes within the App.

7. DATA PRIVACY AND PROTECTION

7.1 Information We Collect

The App collects and stores the following information:

– Your name, email address, and Insured ID (provided during registration).
– Payment transaction history (amounts, dates, confirmation numbers, card type, last four digits).
– Auto-Pay enrollment status and preferences.
– Payment reminder preferences.
– Device tokens for push notifications (if enabled).

7.2 How We Use Your Information

Your information is used solely for the following purposes:

– Authenticating your identity and providing access to the App.
– Processing insurance premium payments.
– Sending payment receipts, reminders, and Auto-Pay notifications.
– Displaying your policy and billing information within the App.
– Improving the functionality and performance of the App.

7.3 Information We Do NOT Collect or Store

– Full credit or debit card numbers.
– Card CVV/security codes.
– Biometric data.
– Location data (GPS coordinates).
– Contacts, photos, or other personal files from your device.

7.4 No Sale of Personal Information

Moylan’s Insurance will never sell, rent, lease, trade, or otherwise distribute your personal information to any third party for marketing, advertising, or any other commercial purpose. This commitment is absolute and without exception.

7.5 Third-Party Data Sharing

Your information may be shared with the following third parties solely for the purposes described in these Terms:

– Authorize.net — for payment processing and card tokenization.
– SendGrid — for sending transactional emails (receipts, reminders, notifications).
– Google Firebase — for secure data storage, push notifications, and application hosting.

We do not share your information with any other third parties unless required by law, court order, or governmental regulation.

7.6 Data Retention

Your account data is retained for as long as your Moylan’s Insurance policy is active and your App account exists. Payment transaction history is retained for recordkeeping purposes. You may request deletion of your account data by contacting Moylan’s Insurance directly.

8. SECURITY MEASURES

Moylan’s Insurance implements reasonable and appropriate administrative, technical, and physical safeguards to protect your personal information, including:

– Encryption of data in transit using SSL/TLS protocols.
– Secure cloud infrastructure provided by Google Firebase.
– PCI-DSS compliant payment processing through Authorize.net.
– Tokenization of card data to prevent storage of sensitive payment information.
– Access controls limiting data access to authorized personnel only.

While we strive to protect your personal information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security, and you acknowledge and accept this inherent risk when using the App.

9. USER RESPONSIBILITIES

By using the App, you agree to:

– Provide accurate and truthful information during registration and payment.
– Maintain the security and confidentiality of your login credentials.
– Notify Moylan’s Insurance immediately if you suspect unauthorized access to your account.
– Use the App only for its intended purpose of managing your Moylan’s Insurance policies and payments.
– Not attempt to reverse-engineer, decompile, modify, or tamper with the App.
– Not use the App for any unlawful, fraudulent, or malicious purpose.
– Not attempt to access another user’s account or data.
– Not use automated systems (bots, scrapers, etc.) to interact with the App.

10. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MOYLAN’S INSURANCE DOES NOT WARRANT THAT:

– THE APP WILL BE AVAILABLE AT ALL TIMES, UNINTERRUPTED, OR ERROR-FREE.
– DEFECTS IN THE APP WILL BE CORRECTED.
– THE APP OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
– THE RESULTS OBTAINED FROM USING THE APP WILL BE ACCURATE OR RELIABLE.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOYLAN’S INSURANCE UNDERWRITERS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

– ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
– ANY LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES.
– ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.
– ANY DAMAGES RESULTING FROM INTERRUPTION, SUSPENSION, OR TERMINATION OF THE APP.
– ANY DAMAGES ARISING FROM THIRD-PARTY SERVICES (INCLUDING AUTHORIZE.NET, SENDGRID, AND GOOGLE FIREBASE).

IN NO EVENT SHALL MOYLAN’S INSURANCE’S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID THROUGH THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Moylan’s Insurance Underwriters, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

– Your use or misuse of the App.
– Your violation of these Terms.
– Your violation of any applicable law or regulation.
– Any information you provide through the App that is inaccurate, false, or misleading.

13. INTELLECTUAL PROPERTY

The App, including its design, layout, graphics, text, logos, and all content, is the property of Moylan’s Insurance Underwriters and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the App without prior written consent.

14. SERVICE AVAILABILITY

The App depends on third-party services including but not limited to internet connectivity, Apollo policy management system, Authorize.net payment processing, Google Firebase cloud services, and SendGrid email services. Moylan’s Insurance is not responsible for any disruption, downtime, or unavailability caused by these third-party services.

Moylan’s Insurance reserves the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, and without liability to you.

15. MODIFICATIONS TO TERMS

Moylan’s Insurance reserves the right to update or modify these Terms at any time. Changes will be effective upon posting within the App. Your continued use of the App after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Territory of Guam, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of the Territory of Guam.

17. TERMINATION

Moylan’s Insurance may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms, policy cancellation, or discontinuation of the App.

Upon termination:

– Your right to access and use the App will immediately cease.
– Any stored payment tokens associated with your account will be deleted from Authorize.net.
– Your payment history and account data may be retained as required for business recordkeeping and legal compliance.

18. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

19. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Moylan’s Insurance Underwriters regarding the use of the App and supersede all prior agreements, communications, and understandings related to the App.

What Information Do We Collect?
  • Personal Information You Provide to Us – We only have access to and collect personal information (such as your name, date of birth, social security number, credit card number, mailing or billing address, telephone number, or email address, and email preferences (collectively, “Personal Information”) that you voluntarily give us via email or other direct contact from you. We will not sell or rent your Personal Information to anyone. We are the sole owners of the Personal Information collected on this Site.
  • Information Collected by Automated Means – Whenever you use the Site, we, as well as any of our third-party advertisers and/or service providers, may use a variety of technologies that automatically collect information about how the Site is accessed and used (“Usage Information”). Usage Information may include, in part, browser type, operating system, the page served, the time, how many users visited the Site, and the website you visited immediately before the Site. This statistical data provides us with information about the use of the Site, such as how many visitors visit a specific page on the Site, how long they stay on that page, and which hyperlinks, if any, they “click” on. Usage Information helps us to keep the Site fresh and interesting to our visitors and to tailor content to a visitor’s interests. Usage Information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we treat it as Personal Information.
  • Device Identifiers – In the course of collecting Usage Information we may also collect your IP address, MAC Address or other unique identifier (each a “Device Identifier”) for the computer, mobile device, Wi-Fi card, or other technology (collectively, “Device”) you use to access the Site. A Device Identifier is a number that is automatically assigned to your Device when you access a web site or its servers. Our computers identify your Device by its Device Identifier. When you visit the Sites, we may view your Device Identifier. We use this information to identify repeat visitors to our Site. We also may use this information to send you targeted advertisements and to enhance the Site. We may associate your Device Identifier with your Personal Information.

The technologies used on the Site, including Device Identifiers, to collect Usage Information may include, without limitation:

  • Cookies – Cookies are data files placed on a Device when it is used to visit the Site. We may use cookies to collect and store certain information about you. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them).

Cookies and web beacons (together, “Site Cookies”) may enable us to track and target the interests of our users to enhance the experience on our Site, track user actions/behavior on our Site and track the effectiveness of ads.

ReachLocal

We also work with a company called ReachLocal, which assists us in advertising our products and/or services. One of the products that we may purchase from ReachLocal is a retargeting product, which enables ReachLocal to show you advertisements for our Site when you visit other sites in the ReachLocal network or in third-party networks. ReachLocal is able to do this through the use of cookies that are provided by ReachLocal through its third-party partners (“Advertising Cookies”). The sole use of the Advertising Cookies is to show you advertisements for our Site; they are not being used to target you in any other way. Moreover, ReachLocal does not link or otherwise connect the information in the Advertising Cookies to any Personal Information that you may have provided.

Please note that ReachLocal retains the ability to access all information that is retained in the ReachLocal Platform for purposes of quality assurance and campaign assessment.

Analytics

We use two products to analyze activity on our site. We use ReachLocal’s tracking technology and/or Google Analytics to understand how users use our site so as to enhance the user experience on our Site. How Do We Use Your Information?

  • Registration – A user may need to first complete a registration form in order to use the Site. During registration, a user is required to give certain information (such as name and email address). This information is used to contact you about the products/services on our Site in which you have expressed interest. At your option, you may also provide demographic information (such as gender or age) about yourself, but it is not required.
  • Orders – We may request information from you on our order form. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number, expiration date). Do We Share Your Information?

The computers/servers in which we store Personal Information are kept in a secure environment.

We may share aggregated demographic information with our partners and advertisers. This is not linked to any Personal Information that can identify any individual person.

We will disclose Personal Information when we believe in good faith that such disclosures (a) are required by law, including, for example, to comply with a court order or subpoena, or (b) will help to: enforce our policies; enforce contest, sweepstakes, promotions, and/or game rules; protect your safety or security, including the safety and security of property that belongs to you; and/or, protect the safety and security of our Site or third parties. In addition, if Moylan’s Insurance Underwriters, Inc or all of its assets are acquired, all of the data collected by us through the Site and through other means and services provided by us would be among the transferred assets.

Your Privacy Rights — Access to and Control Over Information

We offer you choices regarding the collection, use, and sharing of your Personal Information. If you receive promotional communications from us, you may indicate a preference to stop receiving further promotional communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the promotional email you receive or by contacting us directly at the email address or phone number given on our Site. We do not charge for this service, and your opt-out request will be processed within 30 days of the date on which we receive it.

You can do the following at any time by contacting us via the email address or phone number given on our Site:

  • See what data we have about you; if any.
  • Change/correct any data we have about you.
  • Have us delete any data we have about you.
  • Notify us if you do not want us to share your Personal Information for marketing and promotional purposes.
How to Opt-Out of Targeted Advertising

You can set most web browsers to notify you if you receive a cookie, or you may choose to block cookies, though either of those actions may affect the use of our Site. If you prefer to not receive targeted advertising, you can opt out of some network advertising programs that use your information. To do so please visit the Digital Advertising Alliance (DAA) Opt-Out Page: http://www.aboutads.info/choices/. Please note that even if you choose to remove your information (via opting out), you will still see advertisements while you are browsing online. However, the advertisements you see may be less relevant to you and your interests. Additionally, many network advertising programs allow you to view and manage the interest categories they have compiled from your online browsing activities. These interest categories help determine the types of targeted advertisements you may receive. The DAA Opt-Out Page provides a tool that identifies its member companies that have cookies on your browser and provides links to those companies’ pages where you can opt-out of receiving targeted advertisements from companies.

While the Site does not currently respond to ‘Do Not Track’ signals submitted by your browser, you can opt out of any of the Advertising Cookies at any time by simply visiting http://www.reachlocal.com/opt-out to adjust your preferences on placement of Advertising Cookies currently used in connection with ReachLocal’s remarketing product. Does This Policy Apply to Other Websites Linked To Or From the Site?

The Site may contain links to other websites. Any Personal Information you provide on linked pages or sites is provided directly to that third party and is subject to that third party’s privacy policy. This Policy does not apply to such linked sites, and we are not responsible for the content or privacy and security practices and policies of these websites or any other sites that are linked to or from the Site. We encourage you to learn about their privacy and security practices and policies before providing them with Personal Information.

Do We Collect Information From Children Under the Age of 13?

The Site is not intended for use by children under the age of 13, and Moylan’s Insurance Underwriters, Inc does not knowingly collect or use any Personal Information from such children. If we become aware that we have unknowingly collected Personal Information from a child under the age of 13, we will make commercially reasonable efforts to delete such Personal Information from our database.

What Steps Do We Take To Protect Your Information?

We take measures designed to protect your Personal Information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction. We provide physical, electronic, and procedural safeguards to protect Personal Information we process and maintain. Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other types of misuse. To protect the confidentiality of Personal Information maintained in your account, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of the Site by any person using your password. Please advise us immediately if you believe your password has been misused.

Miscellaneous

This Policy and the privacy practices of Moylan’s Insurance Underwriters, Inc will be subject exclusively to the laws of the State of Guam in the United States. Moylan’s Insurance Underwriters, Inc makes no representation that this Policy and our practices comply with the laws of any other country or jurisdiction. Users of the Site who reside outside the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If you reside outside of the United States, by using the Site, you consent to the transfer, processing, and use of your information outside of your country.
